Bombay HC: State Can't Claim Private Land Without Proper Acquisition

The Nagpur bench of the Bombay High Court has ruled that the Maharashtra government cannot claim ownership of private land used for a road in Chandrapur since 1979 without initiating fresh acquisition proceedings. The court held that mere silence or absence of objection from the landowner does not grant the state the right to take over private property. The bench emphasized that lawful acquisition requires either compulsory acquisition or a written agreement, not just the landowner's inaction.

बॉम्बे हाईकोर्ट की नागपुर बेंच ने फैसला सुनाया है कि महाराष्ट्र सरकार चंद्रपुर में 1979 से सड़क के लिए इस्तेमाल की जा रही निजी जमीन पर नए अधिग्रहण की कार्यवाही शुरू किए बिना मालिकाना हक का दावा नहीं कर सकती। अदालत ने कहा कि सिर्फ जमीन मालिक की चुप्पी या आपत्ति न करना राज्य को निजी संपत्ति लेने का अधिकार नहीं देता। बेंच ने इस बात पर जोर दिया कि कानूनी अधिग्रहण के लिए या तो जबरन अधिग्रहण या लिखित समझौता जरूरी है, सिर्फ जमीन मालिक की निष्क्रियता नहीं।
