Supreme Court to Hear Pleas Against CEC's Lifelong Immunity Law

Four petitions challenging a 2023 law granting lifelong immunity to Chief Election Commissioners (CECs) and Election Commissioners (ECs) for official acts will be heard by the Supreme Court on December 18. Petitioners argue this protection exceeds even that provided to the President of India under the Constitution. The law, Section 16 of the CEC and Other Election Commissioners Act, 2023, bars all civil and criminal proceedings against serving or former commissioners for acts done in their official capacity.

सुप्रीम कोर्ट सुनेगा मुख्य चुनाव आयुक्त को आजीवन सुरक्षा देने वाले कानून के खिलाफ याचिकाएं

मुख्य चुनाव आयुक्त (CEC) और चुनाव आयुक्तों (EC) को उनके आधिकारिक कार्यों के लिए आजीवन सुरक्षा देने वाले 2023 के कानून को चुनौती देने वाली चार याचिकाओं पर सुप्रीम कोर्ट 18 दिसंबर को सुनवाई करेगा। याचिकाकर्ताओं का तर्क है कि यह सुरक्षा भारत के राष्ट्रपति को संविधान के तहत दी गई सुरक्षा से भी ज़्यादा है। यह कानून, मुख्य चुनाव आयुक्त और अन्य चुनाव आयुक्त अधिनियम, 2023 की धारा 16, सेवारत या पूर्व आयुक्तों के खिलाफ उनके आधिकारिक क्षमता में किए गए कार्यों के लिए सभी दीवानी और फौजदारी कार्यवाही पर रोक लगाता है।
