Bombay HC Orders Demolition of Illegal Toilet Built Under Swachh Bharat Abhiyan

The Bombay High Court has ordered the demolition of an illegal toilet constructed in Calconda, Margao, under the Swachh Bharat Abhiyan. The court observed that the construction lacked the necessary licence or permission from the competent authority. Despite arguments that the construction was part of a central government scheme, the court stated this did not legalise illegal construction violating law. The case involved a challenge to a Margao Municipal Council order directing demolition, which was upheld by the Goa Municipal Appellate Tribunal.

बॉम्बे हाईकोर्ट ने गोवा के कैलंका, मडगांव में स्वच्छ भारत अभियान के तहत बने एक अवैध शौचालय को गिराने का आदेश दिया है। कोर्ट ने कहा कि इसे बनाने के लिए किसी सक्षम अधिकारी से ज़रूरी लाइसेंस या इजाज़त नहीं ली गई थी। भले ही यह कहा गया कि यह एक सरकारी योजना का हिस्सा था, कोर्ट ने साफ किया कि इससे अवैध निर्माण को कानूनी जामा नहीं मिल जाता। यह मामला मडगांव नगर परिषद के उस आदेश को चुनौती देने से जुड़ा था जिसमें इसे गिराने का निर्देश दिया गया था, जिसे गोवा नगर अपीलीय न्यायाधिकरण ने भी बरकरार रखा था।
