Supreme Court Judge: Voter Disenfranchisement Is Arbitrary, Negates Constitution

Supreme Court Justice Ujjal Bhuyan stated that any process leading to the disenfranchisement of millions of Indian citizens is inherently arbitrary and contradicts the constitutional order. He emphasized that a voter's name cannot be removed from electoral rolls without notice and a hearing, except in cases of death. Justice Bhuyan asserted that the right to vote is fundamental and cannot be detached from a citizen's identity. Opposition leaders, including Jairam Ramesh, cited these remarks to criticize Chief Election Commissioner Gyanesh Kumar, accusing him of violating the Constitution.

सुप्रीम कोर्ट के जस्टिस उज्ज्वल भुइयां ने कहा कि लाखों भारतीय नागरिकों को वोट देने के अधिकार से वंचित करने की कोई भी प्रक्रिया स्वाभाविक रूप से मनमानी है और यह संवैधानिक व्यवस्था के विपरीत है। उन्होंने जोर देकर कहा कि किसी मतदाता का नाम, मृत्यु के मामलों को छोड़कर, बिना सूचना और सुनवाई के चुनावी सूची से नहीं हटाया जा सकता। जस्टिस भुइयां ने दावा किया कि वोट देने का अधिकार मौलिक है और इसे किसी नागरिक की पहचान से अलग नहीं किया जा सकता। जयराम रमेश सहित विपक्षी नेताओं ने इन बयानों का हवाला देते हुए मुख्य चुनाव आयुक्त ज्ञानेश कुमार की आलोचना की और उन पर संविधान का उल्लंघन करने का आरोप लगाया।
