A consumer commission in Ahmedabad has ordered Hyatt Ahmedabad to refund a Rs 34.5 service charge added to a bill for two coffees. The commission ruled that automatically adding service charge, even with a disclaimer, constitutes an unfair trade practice. The hotel must refund the charge plus GST, with 9% annual interest, and pay Rs 2,000 for mental agony and Rs 2,000 for litigation costs. The complainant had cited CCPA guidelines, which state service charges are discretionary and cannot be imposed by default.

अहमदाबाद के एक उपभोक्ता आयोग ने हयात अहमदाबाद को दो कॉफी के बिल में जोड़े गए ₹34.5 सर्विस चार्ज को वापस करने का आदेश दिया है। आयोग ने फैसला सुनाया कि डिस्क्लेमर के साथ भी, सर्विस चार्ज को स्वचालित रूप से जोड़ना एक अनुचित व्यापार प्रथा है। होटल को सर्विस चार्ज के साथ जीएसटी भी वापस करना होगा, जिस पर 9% वार्षिक ब्याज लगेगा, और मानसिक पीड़ा के लिए ₹2,000 और मुकदमेबाजी की लागत के लिए ₹2,000 का भुगतान करना होगा। शिकायतकर्ता ने CCPA दिशानिर्देशों का हवाला दिया था, जिसमें कहा गया है कि सर्विस चार्ज विवेकाधीन है और इसे डिफ़ॉल्ट रूप से नहीं लगाया जा सकता है।
