Bombay HC Orders Builder To Pay Interest On Delayed Flat Possession
Times of India · business
The Bombay High Court has ruled that homebuyers are unconditionally entitled to monthly interest payouts from builders in case of project delays, even if they continue to make payments. This landmark decision came in a case where two buyers paid Rs 2.06 crore for a flat agreed in 2014 with possession due by June 2017. The builder argued that accepting delays meant waiving rights, but the court rejected this, stating RERA's statutory protection cannot be made conditional. The ruling emphasizes that a developer cannot exploit a buyer's patience.
