The Supreme Court has ruled that prior sanction from higher authorities is not required to prosecute a public servant caught demanding bribes. The court clarified that the protection under Section 17A of the Prevention of Corruption Act is intended only for decisions made during official duties. This ruling came while dismissing an appeal by a Rajasthan police constable challenging an FIR for demanding a bribe. The bench stated that demanding a bribe is a criminal act unrelated to official functions, thus not covered by the statutory shield.
