सुप्रीम कोर्ट के जस्टिस उज्ज्वल भुइयां ने कहा कि किसी भी भारतीय नागरिक से वोट का अधिकार छीनना, उसे अपने ही देश में दूसरे दर्जे का नागरिक बनाने जैसा है। उन्होंने जोर देकर कहा कि नागरिकता और वोट देने का अधिकार आपस में गहराई से जुड़े हुए हैं और इन्हें अलग नहीं किया जा सकता, इसे शरीर से आत्मा निकालने जैसा बताया। जस्टिस भुइयां ने दावा किया कि किसी भी प्रक्रिया से बड़ी संख्या में नागरिकों को वोट देने से वंचित करना संविधान के अनुच्छेद 326 और 14 का उल्लंघन होगा, और इसे मनमाना और संविधान के मूल सिद्धांतों पर हमला बताया।
