Road Users Prone to Ignoring Traffic Rules: Delhi High Court Observes
Hindustan Times · india
The Delhi High Court has observed that road users in India frequently disregard traffic regulations and road discipline. This observation was made while dismissing an insurance company's appeal against a compensation award for a man injured in an accident. The court stated that a driver swerving to avoid a stray animal does not automatically absolve them of negligence. Drivers are expected to anticipate hazards like stray animals and exercise reasonable care to prevent accidents, as the 'agony of the moment' principle cannot be mechanically applied to such situations.
