Illegal Detention Invalidates Subsequent Arrest, Says Allahabad HC

The Allahabad High Court has ruled that a formal arrest and remand cannot legalise an earlier illegal detention, applying the "fruit of the poisonous tree" doctrine. The court ordered the release of Ravi Chaurasiya, who was held for nearly 31 hours before formal arrest, and awarded him ₹30,000 compensation. The bench directed an inquiry to fix responsibility for the unlawful custody. It held that if the initial detention was unlawful, subsequent proceedings are vitiated, even if the arrest had valid grounds. The court also expressed displeasure with the SHO's conduct.
