Delhi HC: Insensitive Acts in Matrimonial Home Not Always Cruelty

The Delhi High Court has upheld the discharge of a woman's mother-in-law and sisters-in-law in a dowry harassment case. Justice Madhu Jain stated that allegations against them did not clearly identify individual roles and were largely made collectively. The court noted that every insensitive act within a matrimonial home does not automatically qualify as statutory cruelty. The complainant had alleged dowry demands and harassment after her marriage in 2003, leading to a miscarriage and eventual ousting from the house.

दिल्ली हाईकोर्ट ने दहेज उत्पीड़न के मामले में एक महिला की सास और ननदों को बरी करने के आदेश को बरकरार रखा है। जस्टिस मधु जैन ने कहा कि उनके खिलाफ आरोप में व्यक्तिगत भूमिका स्पष्ट रूप से नहीं बताई गई थी और ये आरोप काफी हद तक सामूहिक रूप से लगाए गए थे। अदालत ने कहा कि वैवाहिक घर में हर असंवेदनशील हरकत स्वतः ही कानूनी क्रूरता नहीं मानी जा सकती। शिकायतकर्ता ने 2003 में अपनी शादी के बाद दहेज की मांग और उत्पीड़न का आरोप लगाया था, जिससे उसका गर्भपात हो गया और अंततः उसे घर से निकाल दिया गया।
