Her father has filed a lawsuit alleging negligence by dentist Ronald David Janz and the clinic. The claim states Virginia experienced seizures and stopped breathing shortly after receiving local anaesthetic, which an autopsy reportedly found caused her death due to systemic toxicity. The family is seeking damages, including funeral expenses, and has previously raised concerns about the investigation into the incident.
