Rs 17.18 Lakh Tax Penalty Over Unexplained Deposits Set Aside By ITAT

The Income Tax Appellate Tribunal (ITAT) has ruled that a tax officer cannot impose a penalty under a different section than what was recorded in the assessment order. In this case, a man faced a Rs 17.18 lakh penalty for unexplained cash deposits of Rs 55.62 lakh. The assessment order initiated penalty proceedings under Sections 271AAC and 272A(1)(d), but the penalty was levied under Section 271(1)(c). The ITAT found this procedural error grounds for relief, setting aside the penalty.

आयकर अपीलीय न्यायाधिकरण (ITAT) ने फैसला सुनाया है कि एक टैक्स अधिकारी मूल्यांकन आदेश में दर्ज धारा के अलावा किसी अन्य धारा के तहत जुर्माना नहीं लगा सकता है। इस मामले में, एक व्यक्ति को 55.62 लाख रुपये की अज्ञात नकदी जमा के लिए 17.18 लाख रुपये के जुर्माने का सामना करना पड़ा। मूल्यांकन आदेश में धारा 271AAC और 272A(1)(d) के तहत जुर्माने की कार्यवाही शुरू की गई थी, लेकिन जुर्माना धारा 271(1)(c) के तहत लगाया गया था। ITAT ने इस प्रक्रियात्मक त्रुटि को राहत का आधार पाया और जुर्माना रद्द कर दिया।
