Supreme Court Upholds IT Dept's Right To Reassess Ex-CJI's Sons' Income

The Supreme Court has upheld a Delhi High Court order permitting the Income Tax department to reassess the income of former Chief Justice of India YK Sabharwal's sons for the assessment years 2008-09 and 2009-10. The apex court ruled that the IT department is not barred from reassessment upon discovering evidence of escaped income. A bench dismissed the appeal, stating the 2015 reassessment notice was valid as it was based on recorded reasons and tangible material from an investigation report.

सुप्रीम कोर्ट ने दिल्ली हाई कोर्ट के उस आदेश को बरकरार रखा है जिसमें पूर्व भारत के मुख्य न्यायाधीश वाईके सभरवाल के बेटों की 2008-09 और 2009-10 के आकलन वर्षों के लिए आय का पुनर्मूल्यांकन करने की अनुमति दी गई थी। शीर्ष अदालत ने फैसला सुनाया कि बची हुई आय के सबूत मिलने पर पुनर्मूल्यांकन से आईटी विभाग को नहीं रोका जा सकता। एक बेंच ने अपील खारिज कर दी, यह कहते हुए कि 2015 का पुनर्मूल्यांकन नोटिस वैध था क्योंकि यह एक जांच रिपोर्ट से दर्ज कारणों और ठोस सामग्री पर आधारित था।
