Pocso Survivor Entitled to Aid Regardless of Physical Injuries, Rules High Court

The Allahabad High Court's Lucknow bench has ruled that survivors of penetrative sexual assault under the Pocso Act cannot be denied statutory compensation due to a lack of physical injuries in medical reports. The court directed authorities to release Rs 3 lakh to a survivor under a state scheme within ten days. It stated that the district steering committee's decision to withhold funds was unlawful, as physical injury is not a prerequisite for establishing penetrative sexual assault.

Pocso एक्ट के तहत यौन शोषण के पीड़ितों को मेडिकल रिपोर्ट में शारीरिक चोट न होने के कारण वैधानिक मुआवज़ा देने से मना नहीं किया जा सकता, यह फैसला इलाहाबाद हाई कोर्ट की लखनऊ बेंच ने सुनाया है। कोर्ट ने अधिकारियों को आदेश दिया है कि राज्य की एक स्कीम के तहत पीड़ित को दस दिनों के अंदर 3 लाख रुपये दिए जाएं। कोर्ट ने कहा कि जिला स्टीयरिंग कमेटी का पैसा रोकने का फैसला गैरकानूनी था, क्योंकि यौन शोषण साबित करने के लिए शारीरिक चोट ज़रूरी नहीं है।
