सुप्रीम कोर्ट ने कहा है कि OBC क्रीमी लेयर का फैसला सिर्फ माता-पिता की सैलरी से नहीं होगा। उनके पद और सामाजिक स्थिति को भी देखना होगा। सिर्फ सैलरी के आधार पर OBC कैंडिडेट्स को बाहर करना गलत है। कोर्ट ने यह भी कहा कि सरकारी नौकरी के बराबर का पद प्राइवेट और PSU सेक्टर में भी देखा जाना चाहिए। सरकार ने इस फैसले को लागू करने के लिए दो साल से ज़्यादा का समय मांगा है। यह फैसला उन लोगों को आरक्षण से बाहर रखने के लिए है जो सामाजिक और आर्थिक रूप से आगे बढ़ चुके हैं।
