Jharkhand HC: Property Sale Doesn't Evict Tenants

The Jharkhand High Court has ruled that the mere sale of a tenanted property cannot automatically lead to the eviction of existing tenants. Justice Ananda Sen directed the Bihar State Financial Corporation (BSFC) to act as the landlord and accept rent from tenants until the property is transferred to a new buyer. This decision came after five tenants challenged an eviction notice from BSFC. The court emphasized that eviction must follow specific legal grounds outlined in the Jharkhand Building Control Act, not just a property sale.

झारखंड HC: संपत्ति बेचने से किरायेदार बेदखल नहीं होंगे

झारखंड हाई कोर्ट ने फैसला सुनाया है कि किराये की संपत्ति की सिर्फ बिक्री से मौजूदा किरायेदारों को अपने आप बेदखल नहीं किया जा सकता। जस्टिस आनंद सेन ने बिहार स्टेट फाइनेंशियल कॉरपोरेशन (BSFC) को मकान मालिक के तौर पर काम करने और संपत्ति नए खरीदार को सौंपे जाने तक किरायेदारों से किराया स्वीकार करने का निर्देश दिया। यह फैसला तब आया जब पांच किरायेदारों ने BSFC से मिले बेदखली नोटिस को चुनौती दी थी। कोर्ट ने इस बात पर जोर दिया कि बेदखली संपत्ति की बिक्री मात्र से नहीं, बल्कि झारखंड बिल्डिंग कंट्रोल एक्ट में बताए गए खास कानूनी आधारों पर ही होनी चाहिए।
