Retiring Before Increment Date No Ground To Deny

The Uttarakhand High Court has ruled that a government employee cannot be denied an annual increment simply because they retired one day before the increment became payable. Justice Pankaj Purohit directed the state to grant the increment due to Ramakant Ram, who retired on June 30, 2016, and was initially denied the benefit due on July 1, 2016. The court emphasized that the increment is for service already rendered. It also ordered the re-fixation of his pension and retirement dues based on the revised salary.

रिटायरमेंट की तारीख से इंक्रीमेंट रोकने का आधार नहीं

उत्तराखंड हाई कोर्ट ने फैसला सुनाया है कि सरकारी कर्मचारी को सिर्फ इसलिए सालाना इंक्रीमेंट देने से मना नहीं किया जा सकता क्योंकि वह इंक्रीमेंट मिलने से एक दिन पहले रिटायर हो गया था। जस्टिस पंकज पुरोहित ने राज्य को रामकांत राम को उनका इंक्रीमेंट देने का निर्देश दिया, जो 1 जुलाई 2016 को देय था, लेकिन उन्हें 30 जून 2016 को रिटायर होने के कारण शुरू में यह लाभ नहीं दिया गया था। कोर्ट ने इस बात पर जोर दिया कि इंक्रीमेंट पहले की गई सेवा के लिए है। कोर्ट ने यह भी आदेश दिया कि संशोधित वेतन के आधार पर उनकी पेंशन और रिटायरमेंट बकाए को फिर से ठीक किया जाए।
