Supreme Court Split on Election Commissioner Appointment Law

The Supreme Court has delivered a split verdict on whether to refer petitions challenging the law governing the appointment of the Chief Election Commissioner and Election Commissioners to a five-judge bench. One judge declined the request, while another supported it. The bench has now unanimously referred the matter to the Chief Justice of India to constitute a Constitution Bench to decide the validity of the 2023 Act, which excludes the Chief Justice.
